Privacy Policy

1. General Information

We take the protection of your personal data seriously. This Privacy Policy explains how personal data are processed when you visit the website of THE DC COLLECTIVE or contact us through it.

THE DC COLLECTIVE is a shared market brand for independent specialist businesses in the data-centre sector. This website is operated by ALDERMAN. Where individual DCC member businesses provide services, the relevant member business is identified as the contracting entity for the particular engagement.

We process personal data in accordance with applicable data-protection law, in particular the General Data Protection Regulation (“GDPR”), the German Federal Data Protection Act (“BDSG”) and, where applicable, German rules governing the use of cookies and similar technologies.

2. Controller

If you have questions about this Privacy Policy or wish to exercise your data-protection rights, please contact us using the details above.

3. Website Access and Server Log Files

When you visit our website, technical data are automatically processed by our hosting provider and/or website platform. This may include:

  • IP address;

  • date and time of access;

  • pages and files accessed;

  • referring website or URL;

  • browser type and version;

  • operating system and device information;

  • HTTP status codes and other technical log information.

We process these data to provide the website, maintain its security and stability, detect and prevent misuse, and investigate technical errors.

The legal basis is Article 6(1)(f) GDPR. Our legitimate interest is the secure, reliable and ebective operation of our website.

Log data are retained only for as long as necessary for the above purposes and are then deleted or anonymised, unless longer retention is required to investigate security incidents or comply with legal obligations.

The Website is hosted by Squarespace.

4. Contact Enquiries

If you contact us by email, telephone or contact form, we process the personal data you provide.

This may include your name, company, job title, contact details, the content of your enquiry and any attachments.

We process these data to respond to your enquiry, assess whether and how THE DC COLLECTIVE can assist, prepare a potential engagement and, where relevant, administer the resulting business relationship.

The legal basis is:

  • Article 6(1)(b) GDPR, where the enquiry concerns the initiation or performance of a contract; and/or

  • Article 6(1)(f) GDPR, based on our legitimate interest in responding to business enquiries and managing professional relationships.

Providing the data requested in a contact form is voluntary. However, without the information necessary to understand and respond to an enquiry, we may be unable to process it.

We retain enquiry data for as long as necessary to address the enquiry and, where a business relationship results, for the duration of that relationship and any applicable statutory retention periods.

5. Sharing Enquiries within THE DC COLLECTIVE

THE DC COLLECTIVE brings together independent specialist businesses. If your enquiry concerns a service area provided by a particular DCC member business, we may propose introducing you to that member.

We will only share your contact details and enquiry with an independent DCC member business where:

  • you have requested or agreed to the introduction;

  • sharing is necessary to take steps at your request before entering into a contract; or

  • another valid legal basis under Article 6 GDPR applies.

The receiving DCC member business will process the data it receives as an independent controller under its own privacy policy. The member business will be identified to you before or at the time your information is shared.

This section is particularly important for Ihre Struktur: Es verhindert den Eindruck, dass Daten automatisch und unkontrolliert in einen „Collective-Pool“ gehen. Gleichzeitig bleibt die DCC-Vermittlungsfunktion einfach nutzbar.

6. Newsletter and Other Communications

If you subscribe to a newsletter or request to receive marketing communications, we process your email address and any additional information you provide for that purpose.

The legal basis is your consent under Article 6(1)(a) GDPR. You may withdraw your consent at any time with future ebect, for example by using the unsubscribe link included in each newsletter or by contacting us.

We use a double opt-in process where required or appropriate. We may retain evidence of your consent and withdrawal for as long as necessary to demonstrate compliance with legal obligations.

The Newsletter is provided by Squarespace.

7. Cookies and Similar Technologies

Our website uses cookies and similar technologies. Cookies are small text files stored on your device.

Some are necessary for the technical operation, security and functionality of the website. These necessary technologies are processed on the basis of Article 6(1)(f) GDPR and, where applicable, the relevant provisions of German telecommunications and digital-services law.

We only use non-essential cookies or similar technologies – including those used for analytics, performance measurement, advertising or embedded third-party content – with your consent, where consent is legally required.

  • public authorities, where disclosure is legally required.

Where service providers process personal data on our behalf, we enter into data-processing agreements in accordance with Article 28 GDPR where required.

We disclose personal data only where this is necessary for the relevant purpose, legally required, or otherwise permitted by applicable law.

9. International Data Transfers

Some service providers may process data outside the European Economic Area (“EEA”), including in the United Kingdom or the United States.

Where personal data are transferred to a country outside the EEA that is not covered by an adequacy decision of the European Commission, we use appropriate safeguards in accordance with Chapter V GDPR, such as the European Commission’s Standard Contractual Clauses, and implement supplementary measures where required.

You may request further information about the safeguards used for a particular transfer by contacting us.

10. Retention Periods

We retain personal data only for as long as necessary for the purposes described in this Privacy Policy or where legal retention obligations require longer storage.

The retention period depends on the nature and purpose of the data, the duration of a business relationship, applicable commercial and tax retention obligations, and the need to establish, exercise or defend legal claims.

When data are no longer required, we delete or anonymise them, unless continued retention is required by law.
